Terms of Service

Effective May 2, 2026

These terms govern your use of ShieldStack services ("Services"). By purchasing, you agree to these terms.

1. Services

ShieldStack provides accessibility audit and remediation services for Shopify storefronts against WCAG 2.2 Level AA. Specific scope and deliverables are listed publicly at shieldstack.pro and on each invoice.

2. Pricing and payment

  • Prices listed publicly: Audit Sprint $2,490 USD, Audit + Remediation $3,980 USD, Continuous Monitoring $199 USD/month
  • Payment is required upfront for one-time services and on a monthly recurring basis for monitoring
  • We invoice via Stripe; cards charged in USD. Processing fees are included in our prices.

3. Delivery

  • Audit Sprint: 7 business days from kickoff (kickoff = scope confirmation signed)
  • Audit + Remediation: 21 business days
  • Monitoring: monthly summary by 15th of each month

If we miss a deadline by more than 3 business days due to our own delay (not awaiting client input), we credit 10% of fees per additional business day, capped at 50%.

4. Client responsibilities

  • Provide accurate storefront URL and a guest test login
  • Respond to onboarding email within 2 business days
  • Apply remediation work using deliverables we provide (unless Audit + Remediation tier was purchased)

5. Intellectual property

  • Deliverables (audit report, CSV, accessibility statement, remediation code) are owned by you upon delivery
  • Our methodology, templates, and tooling remain ours
  • You may share deliverables internally and with authorized vendors freely

6. Refunds

  • Audit Sprint: full refund if requested before kickoff. After kickoff, no refund (work has begun).
  • Audit + Remediation: 50% refund if requested before remediation phase begins. After remediation begins, no refund.
  • Monitoring: cancel anytime, current month is non-refundable.

7. Limitation of liability

  • We provide technical accessibility conformance review and remediation guidance, not legal advice.
  • We do not guarantee that conformance with WCAG 2.2 AA prevents ADA litigation; conformance is the strongest defensible posture but not a legal shield.
  • Our maximum liability for any claim is the amount you paid us in the prior 12 months.
  • We are not liable for indirect, consequential, or punitive damages.
  • We are not liable for issues introduced after delivery, third-party app issues, or changes you make to remediation work.

8. Confidentiality

  • We treat your store data, traffic data, and any content shared during the engagement as confidential.
  • We may use anonymized findings (no client name, no specific URLs) in marketing materials.
  • We will sign a separate NDA on request for enterprise engagements.

9. Indemnification

  • You indemnify us against claims by third parties arising from how you use our deliverables.
  • We indemnify you against claims that our work product infringes someone else's IP.

10. Termination

  • Either party may terminate any active engagement with 30 days notice.
  • We may suspend service immediately for non-payment after 14 days past due.
  • Termination does not waive any payments owed for work already delivered.

11. Governing law

  • These terms are governed by the laws of Portugal.
  • Disputes are resolved in the courts of Lisbon, Portugal.
  • For US clients: this clause is enforceable; you accept Portuguese jurisdiction by purchasing.

12. Changes

We may update these terms with 30 days notice via email. Continued use of services after notice constitutes acceptance.
